ترجمة قانون اتحادي رقم 1 لسنة 2005

المادة الاولى

يستبدل بنصوص المواد (4) و (6) و(7) و(21) و(26) و(28) و(29) و(30) و(42) من القانون الاتحادي رقم (14) لسنة 1995 المشار إليه النصوص الآتية:

Article (4)

تنشأ بوزارة الصحة وحدات متخصصة لعلاج الإدمان

Specialized units shall be established at the ministry of health for addiction treatment;

ويشرف على كل وحدة لجنة تشكل بقرار من وزير الصحة

each unit shall be supervised by a committee that shall be formed by resolution of the minister of health

على أن يكون من بين أعضائها ممثلون لوزارات الداخلية والصحة والعمل والشئون الاجتماعية وقطاع الشئون الإسلامية والأوقاف بوزارة العدل والشئون الإسلامية والأوقاف

and shall include members representing the ministries of interior, health, labor and social affairs, Islamic affairs and wakfs sector of the ministry of justice, Islamic affairs and wakfs,

وممثل للنيابة العامة يختاره النائب العام

and a public prosecution representative to be selected by the attorney general.

كما تنشأ بوزارة العمل والشئون الاجتماعية مراكز للتأهيل

There shall also be established at the ministry of labor and social affairs rehabilitation centers

تشرف عليها لجنة تشكل بقرار من وزير العمل والشئون الاجتماعية

مادة 6

Article 6[align=center][/align]

1- يحظر جلب واستيراد وتصدير وصنع واستخراج وفصل وانتاج وحيازة وإحراز وتعاطي المواد المخدرة والمؤثرات العقلية
1- It is prohibited to procure, import, export, manufacture, extract, separate, produce, possess, obtain or consume the narcotics or psychotropics

المبينة في الجداول أرقام (1) و(2) و(4) و(5) وسائر أوجه النشاط والتصرفات الأخرى المتعلقة بها.

mentioned in tables (1), (2), (4) and (5) or transact any other activity or act relating thereto.

2- يجوز إجراء الاستعمالات الطبية المراقبة كما يجوز إجراء الأبحاث العلمية على المواد المذكورة

2- It is permitted to conduct a controlled medical use and scientific research on the said substances

بمعرفة جهة علمية متخصصة

by a specialized scientific entity

يصدر بإنشائها و تنظيمها وبيان الأحكام المتعلقة بممارستها لنشاطها قرار من مجلس الوزراء بناء على عرض وزير الصحة

to be created and organized by cabinet resolution setting forth as well the regulations governing its activity, upon proposal of the minister of health

وموافقة اللجنة المنصوص عليها في المادة (3) من هذا القانون.

اظَّنَنْتُ أنَّ as amended تُوحي للقاريء أنَّ القوانيين المذكورة مُعدَّلة وليست مُعدِّلة وزَكِنتُ مارأيتُه صوابًا وإنْ لم يكُّ كذلك فإنَّ عفوَكم معشر المترجمين سيأتيني بغيرِ مسألة. ولكم مِنَّا الثَّناء الجميل ومنَ الله المجازاة

على مدير الجهة المرخص لها بالاتجار في المواد المخدرة أو المؤثرات العقلية أن يعد سجلا لقيد ما يرد إليها وما يصرف منها أولاً بأول وفي ذات اليوم من المواد المذكورة في الجداول أرقام (3) و(6) و(7) و(8) المرفقة بهذا القانون، وترقم صفحات هذا السجل وتختم من الجهة الإدارية المختصة قبل البدء في استعماله

Article (21)
The manager of the entity licensed to trade in narcotics or psychotropics shall prepare a register to enter, on a regular basis on the same day, the quantities received and issued by the pharmacy of the substances mentioned in tables (3), (6), (7) and (8) attached hereto. The pages of this register shall be numbered and stamped by the competent administrative body before starting them.

مادة معدلة 26

مع مراعاة حكم المادة (24) من هذا القانون على مدير الصيدلية أن يعد سجلاً خاصاً لقيد ما يرد إليها من المواد المبينة في الجداول أرقام (3) و(6) و(7) و(8) المرفقة بهذا القانون وما يصرف منها أولاً بأول وفي ذات اليوم وتحدد البيانات الواجب إثباتها في هذا السجل بقرار من وزير الصحة.
وترقم صفحات هذا السجل وتختم من الجهة الإدارية المختصة قبل البدء في استعماله
Article (26)
Subject to the provision of article (24) hereof, the pharmacy manager shall prepare a special register to enter, on a regular basis on the same day, the quantities received and issued by the pharmacy of the substances mentioned in tables (3), (6), (7) and (8) attached hereto. The data to be entered in the register shall be designated by resolution of the minister of health.
The pages of this register shall be numbered and stamped by the competent administrative body before starting them.

مادة معدلة 28

على مدير الصيدلية أن يرسل إلى الجهة الإدارية المختصة خلال الخمسة عشر يوماً الأولى من شهري يناير ويوليو من كل سنة بكتاب مسجل يتضمن بياناً تفصيلياً موقعاً عليه منه بالوارد والمصروف والمتبقي من المواد المبينة في الجداول أرقام (3) و(6) و(7) و(8) المرفقة بهذا القانون حتى نهاية الستة أشهر السابقة

Article (28)
Within the first fifteen days of January and July each year, the pharmacy manager shall send by registered mail to the competent administrative body a detailed statement bearing his signature and showing the quantities received, issued and remaining till the end of the previous six months of the substances mentioned in tables (3), (6), (7) and (8) attached hereto.

يجب على مدير الصيدلية حفظ المواد المبينة بالجدول أرقام (3) و(6) و(7) و(8) المرفقة بهذا القانون داخل خزانة محكمة الإغلاق بالصيدلية وتكون هذه المواد في عهدته

Article (29)
The pharmacy manager shall keep the substances mentioned in tables (3), (6), (7) and (8) attached hereto in a tightly closed cabin in the pharmacy and shall be the custodian of such substances.

مادة معدلة 30

يحظر على غير الجهات المذكورة في البنود (1) و(2) و(3) و(4) من المادة (11) من هذا القانون إنتاج أو استخراج أو فصل أو صنع أية مادة من المواد الواردة في الجداول أرقام (3) و(6) و(7) و(8) المرفقة بهذا القانون.
ولا يجوز للجهات المذكورة في البنود المشار إليها مباشرة أي نشاط من الأنشطة المنصوص عليها في الفقرة السابقة إلا بعد الحصول على ترخيص بذلك من الجهة الإدارية المختصة وتطبق في هذا الشأن أحكام المواد (11) فقرة ثانية و (12) و(13) و(14) و(15) من هذا القانون.

Article (30)
It is prohibited for the entities mentioned in clauses (1), (2), (3) and (4) of article 11 hereof to produce, extract, separate or manufacture any of the substances contained in tables (3), (6), (7) and (8) attached hereto.
The entities mentioned in the said clauses may practise any of the activities provided for in the preceding paragraph only after obtaining the relevant licence from the competent administrative body, in which case the provisions of article (11), second paragraph, (12), (13), (14) and (15) hereof.

يجوز للمحكمة - في غير حالة العود - بدلاً من الحكم بالعقوبات المنصوص عليها في هذا القانون أن تحكم بإيداع الجاني إحدى وحدات علاج الإدمان المشار إليها في الفقرة الأولى من المادة (4) من هذا القانون، وذلك بعد أخذ رأي اللجنة المشرفة على العلاج

Article (42)
Excluding recidivisms, the court may, instead of sentencing the offender to the penalties provided for herein, pass a ruling for committing the offender to one of the addiction units referred to in the first paragraph of article (4) hereof, having consulted the committee supervising the treatment.

كما يجوز للمحكمة أيضا - في غير حالة العود - بدلاً من الحكم بالعقوبات المنصوص عليها في هذا القانون أن تحكم بايداع الجاني إحدى مراكز التأهيل و ذلك بعد أخذ رأي اللجنة المشرفة على التأهيل المشار إليها بالفقرة الثانية من المادة (4) من هذا القانون، ويجب على كل من اللجنتين أن تقدم للمحكمة كل ستة أشهر أو إذا طلب منها ذلك تقريراً عن حالة المحكوم عليه.

Excluding recidivisms, the court may also, instead of sentencing the offender to the penalties provided for herein, pass a ruling for committing the offender to one of the rehabilitation centers referred to in the second paragraph of article (4) hereof, having consulted the committee supervising the rehabilitation. Both committees shall submit to the committee every six months or if they are required to do so submit a report on the convict's condition.

وعلى المحكمة بعد أخذ رأي النيابة العامة أن تأمر بإخراج المحكوم عليه من الوحدة أو من مركز التأهيل إذا تبين من التقرير أن حالته الصحية تسمح بذلك. كما تأمر المحكمة بإخراج المحكوم عليه من الوحدة أو من مركز التأهيل بناء على طلبه بعد موافقة اللجنة المشرفة عليه المشار إليها في هذه المادة وأخذ رأي النيابة العامة.

The convict shall, having consulted the public prosecution, order that the convict be discharged from the unit or the center if it is found from the report that his health condition so permits.
The court shall also order that the convict be discharged from the unit or the center upon his request, subject to the consent of the supervisory committee referred to in this article and consulting the public prosecution.
وفي جميع الأحوال لا يجوز أن تزيد مدة الإيداع للعلاج والتأهيل على ثلاث سنوات
In all cases, the treatment/rehabilitation committal period may not exceed three years.
